Terms of Service

These Terms of Service govern your access to and use of HowToImg. By using the service, creating an account, buying credits, or starting a subscription, you agree to these Terms.

1. Eligibility and Accounts

  • You must be legally able to enter into a binding agreement and old enough to use the service where you live.
  • You must provide accurate registration information and keep your login credentials secure.
  • You are responsible for activity under your account, including generations, uploads, purchases, and moderation appeals.

2. The Service

HowToImg provides AI-assisted generation and editing features for logos, product visuals, avatars, and related media workflows. Features, models, providers, and pricing may change over time.

Some outputs depend on third-party AI, storage, payments, analytics, or support vendors. We do not guarantee that any specific upstream model or provider will remain available.

3. Credits, Billing, and Subscriptions

3.1 Credits

  • Successful generations consume credits based on the selected model, mode, resolution, image count, and other settings shown by the product.
  • Displayed estimates are informational. The final deduction is calculated by the server at generation time.
  • If a generation fails because our system or an upstream provider returns a failed task, we may automatically restore the associated credits.

3.2 Subscriptions and Purchases

  • Subscriptions renew automatically until canceled.
  • You authorize us and our payment providers to charge the payment method associated with your account.
  • Taxes, currency conversion, payment processor fees, and jurisdiction-specific billing rules may apply.

3.3 Refunds and Chargebacks

  • Refunds are governed by our Refund Policy and any non-waivable consumer rights.
  • Chargebacks or payment disputes may lead to temporary account restrictions while we investigate.
  • Fraudulent or abusive refund behavior may result in suspension or permanent closure.

4. User Content and License

You retain ownership of the prompts, uploads, and other material you submit, subject to the rights needed for us to operate the service.

  • You grant us a non-exclusive, worldwide license to host, copy, transmit, process, store, review, and display your content solely to provide, secure, moderate, improve, and support the service.
  • You represent that you have the rights needed to upload reference images, trademarks, likenesses, and any other material you submit.

5. Generated Output and Commercial Use

As between you and us, we do not claim ownership over outputs generated for your account. Your rights in outputs may still depend on the policies of upstream model providers and the rights of third parties depicted or referenced in the output.

Paid plans are intended to support commercial use of outputs, but you remain responsible for reviewing whether an output infringes copyright, trademark, publicity, privacy, platform, or advertising rules before publishing it.

6. Acceptable Use

  • Do not generate, upload, request, or distribute illegal, exploitative, or abusive content.
  • Do not create non-consensual intimate imagery, child sexual content, extremist propaganda, targeted harassment, or content that meaningfully facilitates violence or self-harm.
  • Do not infringe copyright, trademark, privacy, publicity, or other third-party rights.
  • Do not impersonate real people, fabricate evidence, evade safety filters, scrape the service, reverse engineer protected systems, or run abusive automation against the platform.
  • Do not use the service to resell raw access to our tools or operate a competing automated generation API without our written permission.

7. Moderation and Enforcement

We may review content, restrict prompts, remove outputs, refund or revoke credits, suspend features, or terminate accounts when we believe content or behavior violates these Terms, our Content Policy, law, or partner requirements.

Users may submit reports and appeals through available product flows. Moderation decisions are made in our reasonable discretion.

8. Intellectual Property Complaints

We respond to copyright and other rights complaints under our Copyright and DMCA Policy. Repeated infringement or repeat abuse may lead to account termination.

9. Third-Party Services

The service may include or depend on third-party tools, model providers, payment processors, analytics, ads, support widgets, and storage vendors. Those third parties may have their own terms and privacy policies, and we are not responsible for their independent acts or omissions.

10. Disclaimers and Limitation of Liability

The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, perfect model quality, factual accuracy, non-infringement, merchantability, or fitness for a particular purpose.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, or business opportunity arising from your use of the service.

11. Suspension, Termination, and Changes

  • We may suspend or terminate access if you violate these Terms, abuse payments, create legal risk, or threaten the security or integrity of the platform.
  • You may stop using the service at any time and may request account deletion subject to our retention obligations.
  • We may update these Terms from time to time. Continued use after an update means you accept the revised Terms.
